Title

Consider a resolution authorizing the Mayor to execute the FY 2023 "Equitable Sharing Agreement and Certification" confirming the City's receipt and expenditure of federal asset forfeiture awards and agreeing to continue to participate in the receipt of federal forfeiture awards.

Body

The proposed resolution authorizes the submission of an annual report to the federal government that confirms the receipt and expenditure of asset forfeiture awards from federal courts. Forfeitures of currency and other property occur when law enforcement determines that property is connected to a crime. This annual report also includes an affidavit and agreement that allows the City to continue to receive federal awards from asset forfeiture proceedings. Forfeitures awarded through court processes comprise what goes into the City’s Law Enforcement Fund every year.

In Fiscal 2023, The Department started with a balance of $102,187.77, with $99,799.97 in Treasury department awards and the balance in Justice funds. No federal funds were spent in FY 2023, and the year ended on the Justice Department side with $2,464.82. On the Treasury side, the Department received a total of $6,194.15 in additional forfeiture awards, plus $3,774.21 in interest. FY 2023 ended in that portion of the federal total with $109,768.33.
