Title
Consider a resolution authorizing the President to execute Work Change Directive No. 001 to the BCRUA Phase 2 Raw Water Delivery System with Thalle/SAK Joint Venture, for a possible emergency decommissioning of the existing raw water intake barge, due to low lake levels in Lake Travis.
Body
This Work Change Directive is being issued due to continuing drought and lowering of the water level of Lake Travis. LCRA’s latest projections show that by early June 2024, the lake could drop to a level that would require decommissioning of the existing raw water intake barge and moving it to deeper water to preserve and protect the facility from damage. In this event, the BCRUA treatment plant will be taken off-line until such time that the lake rises to a level which would allow re-commissioning. The three (3) partner cities would utilize their water treatment plants during this time.
Thalle/SAK Joint Venture is currently the contractor constructing the Phase 2 raw water delivery system in the immediate vicinity of this facility and has the familiarity, experience and resources to expedite this project in the short amount of time available. The “work change directive” is a method prescribed in most construction contracts, including this one, which allows the owner to direct the contractor to perform additional work on a mutually agreed or “cost of the work” basis once the work is complete. It is useful in situations like this where it is too early to generate a cost estimate, yet we need to authorize the contractor to begin work immediately. Once the project is complete, and we have come to agreement on the cost, a change order will be brought to the Board for approval. We hope to have an order of magnitude cost estimate for the Board meeting on April 24, 2024.
The BCRUA staff, Walker Partners and general counsel recommend approval of the resolution and the work change directive.
