Title

Consider a resolution authorizing the BCRUA President to execute a Professional Consulting Services Agreement with Terracon Consultants, Inc. for provision of Construction Materials Testing (CMT) Services for Phase 2 Raw Water Delivery System.

...Body

The current engineering firm providing construction materials testing (CMT) for the Phase 2 Raw Water Delivery Project is TSIT.  They were selected in June of 2022 and a contract was approved by the Board.  However, the company is non-performing at this point and Walker Partners is strongly recommending we terminate the contract as soon as possible and get another testing company under contract as soon as possible.  The existing contract allows termination by the General Manager and becomes effective immediately upon delivery of a termination notice.  I have reviewed this matter with the Board’s general counsel, and he concurs.  Walker Partners interviewed two qualified professional engineering firms who provide these services and the firm we are recommending is Terracon Consultants, Inc.  They are also currently the CMT Engineer on the Phase 1D project and are doing an excellent job.  The attached contract proposal from Terracon is a time and materials contract with an estimate of $250,140 and a recommendation for $280,000 as a contingency.  Staff supports this and recommends a maximum of $280,000 without owner approval.

Staff and the Engineering Operations Committee recommend approval of the attached resolution authorizing the President to execute a Professional Consulting Services Agreement with Terracon Consultants, Inc. for provision of Construction Materials Testing (CMT) Services for Phase 2 Raw Water Delivery System.   Funding will be provided from the Phase 2 project budget.
