Consider a public hearing to consider amendments to the land use assumptions and capital improvement plans and the amendment of roadway impact fees.

BACKGROUND:

 

The Roadway Impact Fee Ordinance originally adopting the Roadway Impact Fee was approved by City Council on March 14, 2019. State Legislation requires a periodic update of no more than every 5 years on the Land Use Assumptions and Capital Improvement Plans included in the Roadway Impact Fee Study. The Capital Improvements Advisory Committee recommended approval of the 2023 Roadway Impact Fee Study on September 6, 2023, with the implementation of the collection rate as recommended by City Staff.

 

STAFF REVIEW AND ANALYSIS:

 

The following calendar is recommended to complete the 2023 Roadway Impact Fee Study adoption:

 

September 6, 2023: CIAC review and recommendation on draft report, with recommendation letter to CC.

 

September 14, 2023: CC Meeting to order the Public Hearing for October 26, 2023

 

Publish the 30-day notice week of September 18, 2023.

 

October 26, 2023: Public Hearing and First Reading of the Ordinance. Do not close the public hearing, continue it to Second Reading which will occur after completion of ROW annexations.

 

TBD: Close Public Hearing and Second Reading of the Ordinance adopting the 2023 Roadway Impact Study.

 

RECOMMENDED MOTION:

 

Open the Public Hearing. At the conclusion of any public comment continue the Public Hearing to Second Reading.

 

Approve the First Reading of the Ordinance to adopt the 2023 Roadway Impact Fee Study and implementation plan that includes:

 

Continue with Phase 3 of implementation from the original Roadway Impact Fee Ordinance adopted in beginning on January 1, 2024, through December 31, 2024, which has a collection rate of 60% for Residential and 30% for Non-Residential based on Final Plat recordation on or after January 1, 2024 of the maximum Fee of $2,511.

 

Beginning January 1, 2025, Implement Phase 4 of the new Maximum Fee of $5,370 for Service Area A and $3,818 for Service Areas B, C and D. With the following collection rate:

 

• Residential – 60% of maximum in A for A, 60% of Maximum in C for B, C, and D

 

• Non-Residential – 30% of maximum in A for A, 30% of Maximum in C for B, C, and D
