Consider a resolution authorizing the Mayor to execute an Engagement Letter with McCall Parkhurst & Horton for legal services in connection with the issuance of bonds, certificates of obligation, notes or other obligations by the City.

 

Body

​The City of Round Rock’s wastewater flows into the Brushy Creek Regional Wastewater System (BCRWWS). The regional system is owned by the City of Round Rock, City of Cedar Park, City of Austin, and City of Leander. The BCRWWS consists of two wastewater treatment plants (WWTP), the East WWTP and the West WWTP. The East WWTP is nearing construction completion to increase the capacity to 30 million gallons per day (MGD), bringing the total treatment capacity of the BCRWWS to 33MGD.

 

The Expansion to 40MGD project for the East WWTP is under design by Plummer and Associates, Inc. and expected to start construction in early 2027. The construction cost estimate for the 40MGD project is approximately $117.6 million. Round Rock’s cost allocation is 90%, or approximately $105.8 million. Due to the significant cost of the project, the Texas Water Development Board Clean Water State Revolving Fund (TWDB CWSRF) Loan Program was pursued to finance a portion of Round Rock’s allocation of the construction cost. Due to many key project features, the 40MGD project ranked high among other projects submitted across the state, and in October 2025, the City of Round Rock was invited to apply to the CWSRF program.   

 

The City is applying for $60 million in the low-interest TWDB CWSRF loan program. McCall, Parkhurst & Horton LLP has provided bond counsel services to the City for its other bond issuances for many years and is the chosen authorized representative for bond counsel relating to the CWSRF application.
