Title

Consider a resolution authorizing the Brushy Creek Regional Utility Authority (BCRUA) to approve Supplemental Contract No. 11 with Walker Partners/Freese and Nichols Joint Venture for the BCRUA Phase 2 Raw Water Delivery System Project.

 

Body

The initial  contract  for  the  design  of  the Phase  2  Raw  Water  Delivery  System  Project, in  the  amount  of  $12,518,037, was awarded to Walker Partners/Freese and Nichols Joint Venture on November 28, 2018.  Since  that  time, ten supplemental  agreements  have  been  awarded  that  increased  the  compensation  to  $13,249,233.

 

Supplemental  Agreement  No. 11 includes engineering services for providing bid  phase  services  for  the Phase 2 Raw Water Delivery System Project. The BCRUA Board voted to use the Competitive Sealed Proposal (CSP)  delivery  method  for  this  project. Under  competitive  sealed  proposals,  changes  in  the  nature  of  a  proposal, and in prices, may be negotiated after proposals are opened. The project team will receive and evaluate  proposals  and  make  a  recommendation  to  the  BCRUA Board  to  award  the  project  as  a  single construction contract to the selected contractor.

 

The total compensation for Supplemental Amendment No. 11 will not exceed $745,999 and will increase the total compensation to $13,995,121.  Funding for this Supplemental Agreement for the City of Round Rock’s portion will use Phase 1A project savings. The City of Leander’s and the City of Cedar Park’s portions will use BCRUA’s 2018 SWIFT Loan bond funds. This contract exceeds the BCRUA Board maximum limit of $500,000, and will therefore require separate consideration and approval by all three-member city councils, before final authorization to proceed can be issued.

 

Round Rock’s portion of Supplemental No. 11 is 28.19%, which equates to $210,297.12.  The BCRUA Operations Committee (OC) recommends approval and the Supplemental No. 11 was approved by the BCRUA Board on October 20, 2021.
