Consider a resolution authorizing the Mayor to execute a Second Amendment to the Amended and Restated Master Contract for the Financing, Construction, Ownership and Operation of the Brushy Creek Regional Wastewater System.

Brushy Creek Regional Wastewater Treatment System (BCRWWS) is in the process of expanding the capacity of the East Regional Wastewater Treatment Plant by 10 million gallons per day (MGD) to a capacity of 30 MGD. The City of Leander participated in 42.3% of the expansion project. Funding this percentage of the project gives Leander 4.23 MGD of capacity in the treatment system as a whole, or 12.82% overall.
In addition, Leander agrees to buy into the East and West Wastewater Treatment Plant properties as well as the Administration Office Building located at the East Wastewater Treatment Plant. This additional buy-in was based on a commercial appraisal paid for by the partners. Leander's buy-in for the property and Administration Building was agreed upon as $2,905,341. These funds will be divided by the cities of Austin, Cedar Park and Round Rock according to the previous percentage ownership in the treatment system, as noted below.

As a result of Leander buying into the treatment facilities, the percentage ownership for each partner City changed. The new percentages are as follows:
