These proposed amendments to the Zoning and Development Code consist of a modification to the accessory building setback requirement and clean up corrections resulting from the recently adopted Downtown Mixed-Use Zoning amendments along with some minor errors identified by the city attorney. 

 

Specifically, staff proposes an amendment to Section 2-26(f) of the Zoning and Development Code to clarify the language regarding accessory building setbacks in the residential zoning districts. This amendment addresses ambiguity within the existing regulation which had intended to prevent accessory buildings such as sheds from locating between a home and the public right of way. This lack of clarity resulted in a conflicting interpretation between a property owner and the City, which resulted in an appeal to the Zoning Board of Adjustment, where the Board sided with city staff. By refining the regulation, the City will prevent future administrative disputes with clearer, more precise language.

 

Additionally, proposed amendments to Chapters 2, 8, and 10, correct references to other parts of the Code and are purely clerical. No changes to regulations or policies are proposed.

 

At its July 15, 2026, meeting, the Planning and Zoning Commission recommended approval of the code amendment by a vote of 7-0. There were no speakers during the public hearing. Staff recommends approval.
