Title

Consider a resolution authorizing the Mayor to execute a Settlement Agreement with Paul Cates Stable, LLC for the acquisition of a 0.169 acre parcel required for construction of Gattis School Road - Segments 4 and 5.

 

Body

The City's appraised value for this parcel acquisition was $134,557 ($15.40/SF land + fence/sign), which was accepted by the property owner. However, the owner is unable to deliver clean title to the City due to an ongoing dispute with the note lienholder regarding allocation of the funds.  Therefore, the parties have agreed to proceed with a stipulated condemnation suit to enter the purchase amount. A condemnation resolution to allow the City Attorney to proceed with processing the agreement terms will be authorized by the Council as a separate agenda item.
