Consider authorizing the Mayor to execute a resolution setting a public hearing date to consider land use assumption and capital improvement plans for roadway impact fees.

The Roadway Impact Fee Ordinance originally adopting the Roadway Impact Fee was approved by City Council on March 14, 2019. State Legislation requires a periodic update of no more than every 5 years on the Land Use Assumptions and Capital Improvement Plans included in the Roadway Impact Fee Study. The Capital Improvements Advisory Committee is receiving the 2023 Roadway Impact Fee Study on September 6, 2023. Per the state statute, the City Council has 60 days from the governing body receiving the update to adopt an order setting a public hearing to discuss and review the land use assumptions and capital improvement plans in the 2023 Roadway Impact Fee Study.
STAFF REVIEW AND ANALYSIS:
The following calendar is recommended to complete the 2023 Roadway Impact Fee Study adoption:
September 6, 2023: CIAC review and recommendation on draft report, with recommendation letter to CC.
September 14, 2023: CC Meeting to order the Public Hearing for October 26, 2023
Publish the 30-day notice week of September 18, 2023.
October 26, 2023: Public Hearing and First Reading of the Ordinance. Do not close the public hearing, continue it to Second Reading which will occur after completion of ROW annexations.
TBD: Close Public Hearing and Second Reading of the Ordinance adopting the 2023 Roadway Impact Study.
RECOMMENDED MOTION:
Approve the Resolution setting the public hearing to consider land use assumptions and capital improvement plans for roadway impact fees.
