Consider a resolution authorizing the Mayor to execute an Alternative Standards Agreement with Michael Joseph pursuant to Section 36-123 of the Subdivision Code regarding a non-residential lot near the intersection of McNeil Road and S. IH-35.

 

Body

The City entered into an alternative standards agreement with property owner Michael Joseph on July 9, 2015.  The agreement since expired because the property was not platted within the one year following the City Council's approval.  This action removes the expiration date that was contained in the original agreement. The remainder of the terms in the agreement are unchanged.  The agreement provides for a departure from the adopted design criteria and design and construction standards for a non-residential property due to the unique circumstances of the property.  Lot street frontage will be provided via an easement and construction of the driveway providing access will meet standards provided in the agreement. Please note that this property is currently being considered for purchase by Air Co Mechanical for a major expansion of their business. This business was recently recruited to the City to occupy the previous armory building that sat vacant for several years. This agreement will assist in facilitating the proposed expansion by providing a secondary means of access through Union Pacific Railroad right-of-way, which that entity has authorized.
