Consider a resolution authorizing the Mayor to execute a Real Estate Contract with Avery Ranch Company, Ltd., et al. for the purchase of easement interests required for the City's Reuse Waterline - Phase II Project.

This Phase II Reuse Waterline project continues the City's efforts to provide reuse water to the developing Northeast area of Round Rock. It includes approximately 11,500 feet of 24-inch reuse waterline. The waterline will connect two existing lines; the Phase I Reuse Waterline in Old Settlers Park and the Phase III Reuse Waterline near the intersection of A.W. Grimes and County Road 112.
After design was complete and the easement procurement process was underway, the land owner, Mr. Avery, announced to the City that TxDot had expressed a desire to purchase the MoKan Right-of-Way (ROW) owned by the Avery's and additional land to the east where the Phase II Reuse Waterline had been designed. It became necessary to move the reuse waterline to the west side of the MoKan ROW.
The Phase II Reuse Waterline has been designed to be located within an exclusive permanent City of Round Rock Utility Easement. This easement varies in widths from 10.5 feet on the north segment adjoining an existing City 20 foot easement running parallel to C.R. 112 to a 20 foot easement south from C.R. 112 along the west boundary line of the old MoKan ROW, thence running east along the north line of the Settlers Overlook subdivision. For construction purposes, an additional 50 foot Temporary Construction Easement has been included adjacent to the permanent easement.
The City has offered the Avery's, based on an appraisal, the amount of this Purchase Agreement of $292,230. This equates to $176,849 for the Permanent Easement and $115,381 for TCE for a period of 12 months from the Contractor's Notice to Proceed.
The Avery's have accepted the City's offer.
