Consider public testimony regarding, and an ordinance rezoning 0.27 acres located northeast of the intersection of S. Mays Street and Tower Drive from the SF-2 (Single-Family - Standard Lot) zoning district to the MU-R (Mixed-Use Redevelopment and Small Lot) zoning district. (First Reading)*

This property is owned by the City. It was platted in 1964 and zoned as SF-2 (Single Family - standard lot) in 1969. It was used for a city water storage tank and a ground water well when the city relied on ground water. These facilities were no longer necessary when the city converted to surface water.
The City intends to sell the lot as it no longer serves a public purpose. Because of its location, staff believes that the property is more suitable for mixed use than for single family use. The MU-R (Mixed Use - Redevelopment and Small Lot) district allows cosmetic services, offices, limited retail sales and services, and restaurants/bars. It was created to facilitate development on lots such as this that have frontage on a major roadway and where single-family residential is unlikely to occur. Development standards include:
• Maximum building height is 3-stories or 50 feet.
• A 10-foot building setback required when the site is adjacent to single family.
• A 6-foot-high masonry fence required when nonresidential uses are adjacent to single family.
• Drive-through lanes must be 150 feet from adjacent single family.
The site has frontage on S. Mays Ave and Tower Drive. No access is permitted from S. Mays Ave. There is an existing driveway on Tower Drive.
Prior to the public hearing notice, the City sent an informational notice to the surrounding property owners explaining the proposed zoning change and the potential uses allowed. No responses were received. The Planning and Zoning Commission held a public hearing on April 6, 2022, and voted 7-0 to recommend approval of the rezoning. There were no speakers at the hearing.
