Title

Consider a resolution authorizing the Mayor to execute a Service Area Agreement with the City of Hutto regarding a Wastewater Certificate of Convenience and Necessity boundary amendment for certain property located at the southeast corner of Red Bud Lane and County Road 123.

 

Body

The City of Hutto is requesting a Service Area Agreement with the City of Round Rock to govern the conditions under which Round Rock will begin issuing building permits and providing retail wastewater service to an approximately 31.54-acre tract located at the southeast corner of Red Bud Lane and County Road 123.  Under a separate Interlocal Agreement, Hutto has agreed to release a portion of its wastewater Certificate of Convenience and Necessity (CCN) to allow Round Rock to provide retail service to this tract. This wastewater CCN release is contingent on compensation by the developer (Pulte Homes of Texas, L.P) to the City of Hutto.

 

Under this agreement, Round Rock commits to not issue building permits or provide retail wastewater service to the tract until it receives written confirmation from Hutto that Pulte has satisfied its financial obligations to Hutto under a separate Compensation Agreement. This provision protects Hutto's interest in receiving payment for the release of its wastewater CCN service area rights before development of the tract may proceed.
