Title

Consider a resolution determining the necessity and authorizing the use of the City’s power of eminent domain to condemn certain property interests owned by Bawany Investments, Inc. and located at 1717 South Mays St. which are necessary for the construction of Gattis School Rd., and take other appropriate action.

Body

The City is seeking to purchase a portion of this property for use in widening Gattis School Rd. An initial purchase offer in the amount of the City's appraised value ($46,499) was made on October 21, 2015. A final purchase offer for the same amount was made on December 3, 2015. To date we have not been able to negotiate a voluntary purchase for the ROW, and we have received no specific counteroffer demand from the owners. In the alternative we are also negotiating for a Possession & Use Agreement with the landowners. This is the last outstanding acquisition parcel for this project.
