Title

Consider a resolution amending "Appendix A: Fees, Rates and Charges" to the Code of Ordinances (2018 Edition), adding an annual permit fee for sidewalk furniture in mixed-use districts.

Body

History:
The Downtown Sidewalk Furniture Program, established on October 24, 2013, set a license fee of $25 for the first piece of sidewalk furniture and $5 for each additional piece, with the total fee not to exceed $200 per license. The city issued a sticker for each piece of sidewalk furniture. Over time, this per-item system proved difficult to track and enforce as furniture was added, removed, or replaced by each license holder.

As part of the 2025 program revisions, staff recommended replacing the per-item fee structure with a consistent annual permit fee to simplify administration.

Fee:
The amendment to Appendix A: Fees, Rates and Charges establishes an annual permit fee for sidewalk furniture located downtown. The fee applies to the Annual Sidewalk Furniture Permit required under the Downtown Sidewalk Furniture Program. The Annual Sidewalk Furniture Permit fee is $50.

 

Justification for Fee Amendment:
The amendment aims to:

                     Replace per-item fee with a simplified $50 annual fee tied directly to the Annual Sidewalk Furniture Permit.

                     Provide support for an annual review of sidewalk furniture to ensure compliance with placement, safety, and materials standards.

Recommendation:
Staff recommends approval.
