Consider a resolution authorizing the Mayor to execute the FY 2022 "Equitable Sharing Agreement and Certification" confirming the City's receipt and expenditure of federal asset forfeiture awards and agreeing to continue to participate in the receipt of federal forfeiture awards.

Equitable Sharing is a program in which the proceeds of liquidated seized assets from asset forfeiture are shared between federal and local law enforcement agencies. Asset forfeiture occurs when law enforcement agencies seize assets (cash and vehicles or other property) used during the commission of a crime, and those proceeds are awarded to the Department by a court process. This program is designed to enhance cooperation among the agencies.
In FY 2022, the Law Enforcement Fund started with a balance of $7,571.21 in federal asset forfeiture awards -- two-thirds of which came from Treasury Department awards and the balance from Justice Department awards. During the year, we received an additional $93,773.53 award through court processes and had negative interest income of -$910.52. The Police Department made no expenditures from federal awards in FY 2022, leaving the ending balance of available Treasury and Justice funds at $100,434.22.
The second part of the document is an annual affidavit and agreement that allows the city to continue to receive federal awards from asset forfeiture proceedings.
