Consider a resolution authorizing the Mayor to execute Quantity Adjustment/Change Order No. 1 with Capital Excavation Company for the Gattis School Road Segment 6 Project.

The City opened bids for the Gattis School Segment 6 Project on April 27th 2022. The low bid was Capital Excavation Company with a bid of $17,464,326.27. The contract included a six-month delay to allow for utility providers to complete their relocations for the project. That timeline was not met by the utilities and the project was suspended since October 2022. It has become apparent that holding Capital Ex to a 2-year old bid pricing is not fair or reasonable so the mutual decision was made to terminate the contract.
This Change Order/Quantity Adjustment #1 is to zero out all items that have not been used. The Change Order amount is for $1,119,554.00. The amount of material on hand for the project when re-bid is $929,795.87. The amount that will be removed from the contract price is ($17,290,326.27) and the adjusted contract price is $1,293,554.01.
