Title
Consider a resolution authorizing the Mayor to execute a Memorandum of Understanding with Frankie & Judy Limmer Family Limited Partnership and Ahmadiyya Movement in Islam, Inc. regarding the drainage improvements to Chandler Branch Tributary 3 Project.

Body
The Chandler Branch Tributary 3 Project is a channel improvement project through an area of Williamson County bordered by Sunrise Boulevard to the west, Settlement Drive to the east, Eagles Nest to the north, and Old Settlers Boulevard to the south. This area of the County has become increasingly inundated with floodplain due to unpermitted fill and development in the area over the past several decades. The channel improvements will convey flows through this area of the County to Meadow Lake (Water Control and Improvement District facility No. 14) more efficiently. In effect, the project will relieve floodplain inundation in this area of the County and City.

One of the property owners, Frankie Limmer, was agreeable to helping the City with a cost participation of $50,000 and use of his property during construction. During negotiations, Mr. Limmer entered into an agreement to sell the property to a buyer, AMII. Mr. Limmer remained agreeable to contributing half of the original amount, and AMII agreed to pay the other half, which is outlined in the Memorandum of Understanding (MOU) as $25,000 from each party. In addition to the funds contribution, Mr. Limmer has offered to waive fees for the City’s contractor to dump or utilize certain soils at Mr. Limmer’s quarry near Taylor.

The buyer, AMII, has agreed to allow the use of well water for construction and land for staging construction spoils. Additionally, AMII has agreed to grant easements to the City at no cost. The benefit to AMII is the reduction of floodplain on their tract of land as a result of the City’s channel improvement project.
