Consider a resolution authorizing the Mayor to execute a Retail Water Certificate of Convenience and Necessity Service Area Transfer Agreement with Jonah Water Special Utility District for certain property located in the northeast area of the City of Round Rock's extraterritorial jurisdiction adjacent to Southwest Boulevard near CR 104.

 

Body

The Briggs Tract is a new development located in the northeast area of the City of Round Rock.  The tract is located in both the Jonah Special Utility District (SUD) and the City of Round Rock Certificate of Convenience and Necessity (CCN) water service areas.   Currently, 76 acres of the tract is located within the Jonah SUD CCN service area.  Jonah SUD has agreed to release this CCN service area and the City of Round Rock has agreed to add this acreage to the Round Rock CCN service area.  Round Rock and Jonah SUD find it mutually advantageous to amend their respective CCN service area boundaries in order to achieve and maintain efficient and affordable retail public water service to the future constituents in this development.

 

The Public Utility Commission (PUC) oversees CCN service areas in the state of Texas; therefore, this transfer between the two water providers will require approval by the PUC.   Upon PUC approval of the transfer of the area to the Round Rock CCN service area, Round Rock will be responsible for providing retail water service to the entire Briggs Tract, including the 76 acres that are being released by Jonah SUD.
