Consider a resolution authorizing the Mayor to execute an Interlocal Agreement with the Upper Brushy Creek Water Control and Improvement District regarding the Dam 11 Modification Project.

 

Body

The Upper Brushy Creek WCID (WCID) committed some time ago to adjust the low flow ports on the Dam 11 principal spillway to accommodate the Altman development. At that time, the City expressed interest in potentially leveraging that solution for some pending City (and possibly County) projects.

A recently completed analysis indicated that due to structural constraints, even the smallest adjustment required for the development project, would create excess capacity; furthermore, relatively minor adjustments could generate significant capacity. The City is requesting the WCID optimize the proposed adjustment creating capacity the City would allocate to various projects to compensate for floodplain/easement reclamation and detention needs. Projects that would warrant consideration in the near term include: the Police/Fire training facility, Luther Peterson Yard Site expansion, the conversion of the McNeil Park property, North Mays road extension, etc.
                    
This Interlocal Agreement (ILA) defines a joint project where the City would cost participate to reserve the additional capacity created; the ILA outlines terms and process for the City acquiring and using this valuable regional detention capacity. Initially, the City estimated an amount not-to-exceed of $75,000 to complete the project and gain the additional capacity. A future cost participation payment may be required if a sediment removal trigger is reached in 10 years.

This is an ideal opportunity for two public agencies to leverage creative solutions that preserve public safety while maximizing tax dollars.
