Consider a resolution authorizing the Mayor to execute the Third Amendment to and Partial Assignment of Amended and Restated Consent Agreement Among RSP Partners Development, L.P., SEDCO Devco, Inc., and Siena Municipal Utility Districts 1 and 2.

In October 2006, the City of Round Rock and Siena Municipal Utility District (MUD) Nos. 1 and 2 entered into a Consent Agreement for the establishment of both MUDs in the City's extraterritorial jurisdiction. Since that time, this Consent Agreement has been amended in December 2008 (First Amendment) and in July 2010 (Second Amendment).
This Third Amendment to the Consent Agreement states that the City, Developer and Williamson County have agreed that the County will assume sole responsibility for review and approval of all construction plans, development plans, preliminary plans and subdivision plats with the MUDs. This Third Amendment can occur because on June 13, 2013, the City approved an Interlocal Agreement (ILA) with Williamson County that included the acreage located in the Siena MUD to be within the County's exclusive jurisdiction. The County will now be the governmental entity authorized to regulate subdivision plats and approve related permits with Siena MUD Nos. 1 and 2.
