Consider an ordinance amending Chapter 42, Article VI, Code of Ordinances (2018 Edition), City of Round Rock, Texas, regarding Roadway Impact Fees. (Second Reading)

With the adoption of the 2023 Roadway Impact Fee Study, which makes changes to service areas and maximum assessable roadway impact fee per service unit, Chapter 42 of the City of Round Rock Code of ordinances must be amended to reflect those changes. Chapter 42, Section 42.505 of the code of ordinance also sets out the collection rate and phasing of implementation of the maximum fee. On September 6, 2023, the Capital Improvements Advisory Committee reviewed and made a recommendation on the rates and phasing of implementation along with their review of the draft Study.
STAFF REVIEW AND ANALYSIS:
The amendments to Chapter 42 recommended in this ordinance include:
1. Clarification language on updating the service area boundaries by resolution of Council after future annexations are completed;
2. Codifying the new maximum fee per service unit, while maintaining the original maximum fee for all plats recorded in prior phases on fee administration;
3. Creating a Phase 4, effective January 1, 2025 of a percentage of the new maximum fee; and
4. Adopting the new Land Use Vehicle Mile Equivalency Table (LUVMET) adding over 100 new ITE Land Use categories to better reflect actual development in the fee administration; and
5. Clarifying the appeals process in fee administration.
RECOMMENDED MOTION:
Approve an Ordinance Amending Chapter 42, Article V, Code of Ordinances (2018 Edition) regarding roadway impact fees.
