Consider a resolution authorizing the Mayor to execute Quantity Adjustment/Change Order No. 11 with J.D. Abrams, LP for the Kenney Fort Boulevard Segments 2&3 Project and a related Settlement Agreement.

Kenney Fort Boulevard is an important north/south transportation arterial on the east side of Round Rock. Kenney Fort Segments 2 and 3 extended Kenney Fort Boulevard from Forest Creek Drive to State Highway 45. The City opened bids for the construction of this project in July 27, 2021. The City awarded the contract to the apparent low bidder, J.D. Abrams, in the amount of $23,409,120.97.
Quantity Adjustment/Change Order (QA/CO) No. 11 is a close out adjustment adding some critical items for close out for drainage and signing, adjusting all quantities that were placed over or under planned quantity on the job. This final QA/CO No. 11 includes a settlement for liquidated damages in the amount of $867,650 due to the increased time the contractor spent to complete the project.
The full adjusted contract with this QA/CO is $26,142,174.73. Also Included with this change order is an agreement for final payment and waiving future claims by the city or the contractor.
