Consider a resolution authorizing the Mayor to execute a First Amendment to the Out-of-City Wastewater Service and Development Agreement with QT South, LLC.

 

Body

​​On July 27, 2023, the City entered into an Out‑of‑City Wastewater Service and Development Agreement with QT South, LLC for the proposed QuikTrip convenience store and multifamily development located at the northeast corner of US 79 and CR 110, within Round Rock’s extraterritorial jurisdiction (ETJ). ​

 

The original agreement provided wastewater capacity for a total of 139 Living Unit Equivalents (LUEs), including 5 LUEs for the convenience store, and 134 LUEs for the multifamily portion of the project. As the development has progressed, QT South, LLC has determined that the commercial portion of the project requires additional wastewater capacity for a car wash. The developer has requested an increase of 8 additional LUEs for the car wash. 

 

This First Amendment to the Out-of-City Wastewater Service and Development Agreement updates Section 3.1 to reflect the increased LUE allocation. No other changes to the original agreement are proposed. The multifamily allocation remains at 134 LUEs. All other obligations, including payment of connection fees equivalent to impact fees, extension and construction of the wastewater line, oversize reimbursement provisions, zoning requirements, and voluntary annexation, remain unchanged and in full force. The City has sufficient wastewater system capacity to support the additional LUEs.
