Consider a resolution authorizing the Mayor to execute a Development Agreement with Celina Partners Ltd. regarding the Kenney Fort Boulevard Segments 2 & 3 Roadway Project.

This development agreement formalizes an arrangement in which the city modified the design of the Kenney Fort Segments 2 and 3 project to facilitate access to an adjacent proposed development for the benefit of the developer. In exchange, the developer (Celina Partners Ltd.) will reimburse the city for the cost of the change order to the roadway project, which was approved on April 13, 2023, in the amount of $155,465.13. Specifically, the change order added a median opening, left turn lane, and right turn lane to provide a full access driveway for the development, a high-density multifamily project known as the Westview South PUD.
