Consider a resolution authorizing the Mayor to execute Quantity Adjustment/Change Order No. 2 with Austin Engineering Co., Inc. for the McNeil Road Extension Railroad Culverts Project.

The City issued an NTP (Notice to Proceed) to Austin Engineering Co., Inc. on December 2nd 2022.
This change order #1 is for the casing pipe required by the Railroad. Although a thinner walled pipe was previously approved by UPRR (Union Pacific Railroad) they have changed their specifications and the size and the thickness of the pipe was increased. The contractor deducted the original pipe costs and added in the new thicker walled pipe. The increase in cost for this new pipe is $175,474.00 and the deduction for the old pipe is $62,242.24. For a net of $113,231.56. The adjusted contract total is $982,662.56.
This is Change Order and Quantity Adjustment #2 for this project. This Includes all the items that were not used per the plan quantities due to the project being canceled. The project was canceled due to the method of boring proposed. The previously approved method of boring by UPRR was rejected when the construction started. RailPro's would not allow that type of boring to be used under the railroad tracks. The amount of the deductions on the quantities is $574,347.10.
The Change Order portion of this is for all additional items including agreed upon unit pricing for several of the items which have been negotiated over a period of time. This amount is $431,687.54. Which will bring the adjusted contract price to $840,000.00.
This will close out this project in full.
