Consider a resolution authorizing the Mayor to execute a Cost Participation Agreement with RMD Holdings, L.P. regarding the construction of a waterline within the right-of-way of the proposed Arterial H.

Body

RMD Holdings, L.P. (Developer) has acquired and plans to develop a 28.26 acre tract of land (known as the Palmer Tract) located on the northwest corner of the City of Round Rock's ETJ.  This property is located on the east side of County Road 175, north of Vista Oaks MUD, and south of the Williamson County Southwest Regional Park.  The property is not currently located in the City Limits but there are plans to present this tract of land to the City Council for voluntary annexation into the City of Round Rock.  During our discussions with the Developer, there are cost participation items between the City and the developer that are necessary in order to serve the tract with City water and wastewater utilities.  These items are listed below:

·      The City will design and construct a 16-inch water line to be located in the Arterial H right-of-way from the west side of CR175 to the existing terminus of Arterial H along the southeastern edge of the Williamson County Southwest Regional Park near the Mayfield Ranch subdivision. The Developer will pay their share of the cost for constructing a 12-inch waterline and the City will be responsible for the cost of oversizing the waterline to a 16-inch line.  City agrees to have the waterline constructed within 8 months after the execution of this agreement.

·      Because of the numerous meetings and discussion with the City's legal staff over the past several months, the Developer agrees to pay $5,000 to the City for reimbursement of legal fees incurred by the City for this project.
