Consider a resolution authorizing the Mayor to execute an Out-of-City Water Service Agreement with Tark Properties, LLC.

The property located at 2502 County Road 172 which is located outside of the City’s corporate limits is requesting to enter into an agreement with the City for water service. This agreement between the City and Tark Properties formalizes the terms in which the City would provide water service to the property. The City agrees to provide the owner water service as required for domestic purposes for one commercial business located on the property. The site will require a 5/8-inch water meter which equates to one living unit equivalent and a one-time water capital recovery fee of $4,025. Tark Properties agrees to abide by all mandatory and voluntary water use restrictions imposed by the City on its own citizens. Tark Properties also agrees to pay the City for all water services provided at the rate authorized in Chapter 44, Section 44-30, Code of Ordinances, 2010 Edition. The term of this agreement is for 20 years from the date of the agreement.
