Consider a resolution authorizing the Mayor to execute an Out-of-City Water Service Agreement with Nelson Homestead Family Partnership, Ltd.

The property located at the southeast corner of the intersection of A.W. Grimes Boulevard and University Boulevard, which is located outside of the City’s corporate limits, is requesting to enter into an agreement with the City for water service. This agreement between the City and John Nelson formalizes the terms in which the City would provide water service as required for domestic purposes for three residences located on the property. The City will allow one meter to serve the residences at 4801 and 4811 North A.W. Grimes Blvd. and one meter to serve the residence at 4401 North A.W. Grimes Blvd. The three residences equates to three living unit equivalents and a one-time water capital recovery fee of $12,075. John Nelson agrees to abide by all mandatory and voluntary water use restrictions imposed by the City on its own citizens. John Nelson also agrees to pay the City for all water services provided at the rate authorized in Chapter 44, Section 44-30, Code of Ordinances, 2010 Edition. The term of this agreement is for 20 years from the date of the agreement.
