Title

Consider a resolution authorizing the Mayor to execute an Agreement for the Transfer of Retail Wastewater Utility Service Area between the City of Round Rock and Windermere Utility Company.

 

Body

The City of Round Rock and Windermere Utility Company are both holders of a wastewater Certificate of Convenience and Necessity (CCN) with the Public Utility Commission (PUC) in order to provide retail wastewater service.  The City of Round Rock and Windermere CCNs are located adjacent to each other on the southern boundary of the City of Round Rock.  Due to the topography and the location of existing wastewater utilities in these areas, the parties wish to alter the boundaries of their respective CCNs as follow: 

 

- Round Rock wishes to decertify and transfer an area contained with the Round Rock wastewater CCN and add to the Windermere wastewater CCN as shown in Exhibit A.

 

- Windermere wishes to decertify and transfer areas within the boundaries of their wastewater CCN and add to the Round Rock wastewater CCN as shown in Exhibits B1 and B2.

 

Appropriate applications are in the process of being filed with the PUC to formally transfer the areas between Round Rock and Windermere.  In the meantime, this agreement between Round Rock and Windermere will allow developments in these areas to proceed while the PUC applications are being approved by the PUC.
