Consider a resolution authorizing the Mayor to execute a Wastewater Capacity Agreement with the City of Cedar Park.

In 2010, the Cities of Austin, Cedar Park, Leander, and Round Rock entered into an Amended and Restated Master Contract for the Financing, Construction, Ownership and Operation fo the Brushy Creek Regional Wastewater System (BCRWWS). The Cities are in the process of obtaining a re-rating of the East Brushy Creek Regional Wastewater Treatment Plant (BCRWWTP) to increase the treatment plant rated capacity as well as starting the process to expand the East BCRWWTP by adding facilites that will increase the capacity. Cedar Park had planned on obtaining additional capacity through the re-rating improvements; however, the cities have agreed to delay the improvements necessary for the re-rating in order to combine improvements with a needed expansion project, which will be to the benefit of all of the Cities.

The Master Agreement provides that any City may transfer a portion of its reserved capacity in the East BCRWWTP to another City. Round Rock has surplus capacity in the East BCRWWTP that it is willing to make available to Cedar Park on a temporary basis until the East BCRWWTP is re-rated and the expansion is completed. Round Rock has capacity in the treatment plant which it does not require for at least seven years. Cedar Park is in need of 510,000 gallons per day (GPD) of treatment capacity until the East BCRWWTP is re-rated and the expansion is completed. Round Rock is willing to transfer to Cedar Park 510,000 GPD of East BCRWWTP capacity.

Cedar Park will purchase the temporary right to utilize 510,000 GPD of Round Rock's surplus wastewater treatment capacity in the East BCRWWTP. In consideration of the transfer of the capacity, Cedar Park agrees to pay to Round Rock the lump sum of $10,000, within 30 days after the execution of this Agreement.
