Consider a resolution authorizing the Brushy Creek Regional Utility Authority to approve a Contract with Excel Construction Services, LLC for the Zebra Mussel Control Project.

Zebra Mussels have been identified in a number of lakes in Central Texas, including Lake Travis, which can cause an issue with raw water supply intake structures. This invasive species attaches to metal objects at the intake facilities, as well as attaches to the inner walls of pipelines which inhibits the ability of water providers to transport the necessary volume of raw water to their respective treatment plants. Therefore, the Brushy Creek Regional Utility Authority has designed improvements to help mitigate the infestation of Zebra Mussels to the floating intake structures.

Construction bids for the improvements were opened for this project on Tuesday, July 10th. Responsive Competitive Sealed Proposals (bids) were received from Archer Western, Excel Construction, and CRU. The rank order was as follows:

Excel Construction: $1,558,413.02
CRU $1,745,637.72
Archer Western $1,771,992.02

Based on the recommendation of our design engineer, Walker Partners, the lowest responsive bid was from Excel Construction.

Since the lowest responsive bid exceeded our original budget estimate, the BCRUA Operations Committee (OC) authorized staff and Walker Partners to perform additional Value Engineering on the project and attempt to negotiate a reduction beyond the original bid. Staff and Walker Partners representatives met with representatives of Excel on July 13th and reached agreement on a negotiated Value Engineered Credit of $89,755.00, which reduces the final proposed construction contract to $1,468,658.02.
