Consider a resolution authorizing the Mayor to execute an Interlocal Agreement with the Upper Brushy Creek Water Control and Improvement District regarding the Dam 101 Project.

This Interlocal Agreement (ILA) between the Upper Brushy Creek Water Control and Improvement District (UBCWCID) and the City of Round Rock is for the Dam 101 Project which is designed to remove residential homes within the City that are generally located in the area downstream of the City of Austin and upstream of Interstate Highway 35 from the 100-year floodplain.

In 2014, the parties previously entered into an ILA which set forth the parties respective roles and duties regarding the design and construction of a new dam and inundation easement capable of impeding the flow of flood waters in the Lake Creek Basin area (Dam 101). The UBCWCID and the City desire to terminate the 2014 ILA and adopt a new ILA.

This new ILA states that the UBCWCID shall engage a qualified consulting firm for the engineering, design, and permitting of the Dam 101 project. The UBCWCID shall manage the design services contract such that it results in the development and completion of 100% plans, specifications, and construction cost estimate for the project. The UBCWCID shall also obtain all necessary pre-construction permits. In addition, the UBCWCID will pursue the acquisition and pay for all property rights necessary for the construction and operation of Dam 101 improvements and facilities.

Pursuant to the 2014 ILA, the UBCWCID paid the City $2,000,000 to offset preliminary engineering and design costs for the Dam 101 project. The City has a balance of $956,740 remaining of the $2,000,000 payment. The City agrees to return the remaining balance to the UBCWCID.

The City shall reimburse the UBCWCID on a quarterly basis for all actual costs incurred and paid by the UBCWCID for the engineering, final design, and permitting of the Dam 101 project, but amount of reimbursement shall not exceed $2,...
