Consider a resolution authorizing the Mayor to execute an Amendment to Pass-Through Agreements with Vista Oaks Municipal Utility District.

On June 14, 2001, the City of Round Rock entered into an agreement with Mayfield Ranch development. Subsequently, the City entered into an agreement with the Preserve at Stone Oak development on January 22, 2004. These agreements authorized the City to pass water and wastewater through the Vista Oaks Municipal Utility District (MUD) facilities for the purpose of providing water and wastewater to both developments. The City agreed to pay $3.75 per active wastewater service connection on a monthly basis to the MUD for the use of the MUD's wastewater interceptor and lift station.

It was determined that the City over-paid the MUD $15,326.25 due to not accurately accounting for the number of active City wastewater service connections from November 2016 thru October 2018.

The City is requesting to amend the agreement with Vista Oak MUD to now pay annually in lieu of paying the MUD monthly. Upon approval of this amendment, the City will have an upaid balance of $7,031.25 for the fiscal year 2019. This balance includes the $15,526.25 credit for the City’s overpayment.

The current responsibility of the City is $7,031.25 for the remaining FY2019 balance.
