Consider a resolution authorizing the Mayor to execute an Amended and Restated Agreement for Capacity, Operation, Maintenance, and Capital Improvements to the Lake Creek Collection System.

Body
The City of Round Rock and City of Austin have shared ownership in portions of the wastewater collection system that feeds the Brushy Creek Regional Wastewater Treatment Plants. The three wastewater interceptors owned exclusively by the City of Round Rock and City of Austin include the South Interceptor, Southwest Interceptor and the Lake Creek Interceptor. The ownership and maintenance of these three wastewater interceptors are based on a previous agreement titled Agreement for Capacity, Operation, Maintenance, and Capital Improvements to the Lake Creek Collection System.

A new City of Austin development is under design at the northeast corner of FM1325 and County Road 172. The City of Round Rock owns and maintains a 12-inch wastewater line at this intersection that feeds into the Southwest Interceptor owned by Round Rock and Austin. The City of Austin approached Round Rock about utilizing excess capacity in the existing 12-inch wastewater line for the proposed development. Based on a wastewater flow study, the City of Round Rock determined that they had enough excess capacity in the existing line to serve the needs of the development.

This amendment to the Lake Creek Agreement adds 2,185 feet of the existing 12-inch wastewater main to the shared wastewater collection system identified as the Southwest Interceptor. The City of Round Rock will maintain 75% of the capacity in the 12-inch main and will sell 25% of the capacity to the City of Austin for a fee of $80,635.00. The 25% capacity sold to Austin corresponds to 346 Living Unit Equivalents (LUEs). Based on these revised ownerships, the City of Austin will be able to utilize their 25% capacity in the wastewater main and will be responsible for 25% of the maintenance and replacement costs in the future.
