Consider a resolution authorizing the Mayor to execute a Water Service Area Transfer Agreement with the City of Austin for an approximately 10.66-acre tract of land located at 16400 Bratton Lane.

 

Body

The property at 16400 Bratton Lane is in the process of developing and wishes to receive water and wastewater service from the City of Round Rock. The water and wastewater Certificate of Convenience and Necessity (CCN) which is managed by the Public Utility Commission (PUC) determines who has the designated authority to provide utility service to a property in Texas.

Both the City of Austin and City of Round Rock water and wastewater CCN’s extend onto a portion of this property. To service this property, one of the existing CCN holders must release their CCN on the property. Through negotiations, the City of Austin has agreed to release their water and wastewater CCN on this property. The updated CCN for the property is required to be coordinated through PUC. The property owner has agreed to make all necessary submittals to PUC to direct the CCN modifications.

The Water Service Area Transfer Agreement is an agreement between the City of Round Rock and the City of Austin. The agreement states that the City of Austin will transfer their water and wastewater CCN for this specific property to the City of Round Rock. This agreement is what will be used by the property owner to obtain the CCN modifications on their property with PUC.
