Consider authorizing the Mayor to execute a resolution determining the necessity and authorizing the use of the City’s power of eminent domain to acquire 0.065 acre from property owned by Top Family, LLC.

 

Body

The City's appraised value for the proposed 0.065 acre r.o.w. acquisition was $142,903 ($56,209 Land + $86,694 Improvements/cure). There have been discussions with the owner attorneys regarding perceived access and site impact damage analysis issues, but there has been no acceptance or specific counteroffer proposal to the initial offer (9.2.22) and final offer (10.13.22) correspondence from the City.

I move that the City authorize the use of its power of eminent domain to acquire a 0.065 acre parcel owned by Top Family, LLC located at 4450 E. Old Settlers Blvd. and required for the construction of improvements on the Red Bud North roadway project.
