Consider a resolution authorizing the Mayor to execute a First Amendment to "Agreement for Pass-Through Wastewater Service" with Siena Municipal Utility District No. 1 and Hutto Independent School District.

Hutto Independent School District (ISD) constructed a new elementary school on a site just east of Siena Municipal Utility District (MUD) within the City of Round Rock's extra-territorial jurisdiction (ETJ). The City of Round Rock approved an out-of-city service agreement and pass-through wastewater service agreement for this site on May 9, 2019. The City of Round Rock's participation in the pass-through wastewater service agreement was ensure that the agreement does not count against the amount of wastewater service allowed to Siena MUD.
Round Rock's out-of-city service agreement allowed for the addition of 16 living unit equivalents for future wastewater service that was anticipated for this site. The approved pass-through wastewater service agreement with Siena MUD had the same allowance, but within a fixed time frame for initiation.
This first amendment to the pass-through wastewater service agreement extends the time that Hutto ISD has to request the additional wastewater service by five years of execution of this amendment. The amendment also extends the term of the agreement to be in line with the City of Round Rock's approved out-of-city service agreement, which is April 11, 2039.
