Consider a resolution authorizing the Mayor to execute an Interlocal Agreement with Upper Brushy Creek Water Control and Improvement District for the Dam 14/Meadow Lake Project.

This item formalizes an agreement with Upper Brushy Creek Water Control and Improvement District (UBCWCID). UBCWCID is planning improvements to Dam 14 in Meadow Lake. In order to complete their project, they have asked the City to disconnect a power meter located within an Oncor easement on the dam that feeds a bubbler in the lake. This bubbler is necessary to provide oxygen and aerate the lake water to prevent massive fish die off. The City and District have been working together to find a permanent power source outside of the dam location, but have been unsuccessful to date. UBCWCID has requested that the City allow the District to install a temporary solar option to power the bubbler, provided they pay for the unit, maintain it, and provide a permanent power source. Upon identification of a feasible power source, the City will then request a disconnect at the meter from Oncor and UBCWCID will pay to install that power service. If a permanent power source is not identified, then the City will not terminate the meter.
In addition to the bubbler, the UBCWCID had originally requested construction access through the parkland where Fire Station #1 will be constructed. General Services were engaged in those early conversations/coordination. They had agreed to construct an entrance prior to the Fire Station construction that would be utilized by the UBCWCID contractor (and later by the Fire Station contractor). However, as the Dam 14 project was delayed, it was clear that both projects would be under construction at the same time. The General Services Department requested UBCWCID to obtain a separate construction entrance and agreed to reimburse the payment of construction up to $99,900.
